Refund Policy

Service Scope and Limitations

 

NYX WebWorks (the “Company”) provides website design and related services as agreed upon in the signed client contract. While every effort will be made to deliver a high-quality final product, the Company cannot guarantee specific results, including increased website traffic, sales, or search engine rankings, unless otherwise explicitly stated in a separate contract.

 

Intellectual Property

Upon full payment, the client will own the rights to the final website design and content (excluding any licensed or third-party materials). However, NYX WebWorks reserves the right to showcase the completed work in its portfolio and marketing materials unless the client requests otherwise in writing.

 

Third-Party Services and Tools

The Company may integrate third-party services, tools, or software (e.g., Wix hosting, plugins, or e-commerce platforms). NYX WebWorks is not responsible for the performance, pricing changes, or availability of these third-party services.

 

Client Responsibilities

The client is responsible for providing accurate and timely content, such as text, images, and other assets, and approving the design at each milestone. Delays in providing materials or approvals may result in project timeline extensions.

 

Warranty and Liability

The Company provides its services “as is” and will not be liable for any direct, indirect, or incidental damages arising from the use of the website. Maintenance, updates, and changes after the project’s completion are not included unless a separate maintenance agreement is signed.

Initial Website Creation Fee

• A non-refundable deposit of [X% of the total project cost] is required to secure the project start date. This fee covers initial consultations, research, and design mockups.

• Once work on the website design has commenced, additional payments may be non-refundable depending on the completed milestones.

Cancellation Policy

• If the client decides to cancel the project:

• Before work begins: The deposit will not be refunded.

• After work begins: Refunds will be prorated based on the percentage of work completed. The client will be billed for any additional work beyond the deposit.

• If the Company decides to cancel the project due to unforeseen circumstances, a full or partial refund may be issued at the Company’s discretion.

Monthly Maintenance Fees

• Maintenance fees are billed monthly or annually (as per the agreed contract) and are non-refundable once the payment period begins.

• If the client fails to pay the maintenance fee on time, services may be suspended until payment is received.

Custom Work and Revisions

• Any custom work, including additional revisions beyond the scope outlined in the contract, is non-refundable. The client will be billed at the agreed hourly or project rate for any extra work.

Dissatisfaction Policy

• Nyx Design Web aims for 100% client satisfaction. If the client is unhappy with the design at any stage, they must communicate their concerns through email. The Company will make reasonable efforts to address the issue within the agreed scope of work. Refunds will not be issued for dissatisfaction with approved designs or completed work.

Third-Party Costs

• Costs related to third-party services (e.g., hosting, domain registration, plugins) are non-refundable as they are billed directly by the third-party provider.
