Welcome to NYX WebWorks. By engaging our services, you (“the Client”) agree to the following terms and conditions. These Terms outline your responsibilities and rights and govern your relationship with NYX WebWorks (“we,” “us,” or “the Company”).

 

Services

NYX WebWorks provides professional web design, maintenance, and related services as described in your project proposal or contract.

• Scope of Work: All deliverables and timelines will be outlined in the signed agreement. Any additional work outside the agreed scope will require a separate quote and approval.

• Third-Party Tools: Our services may involve third-party platforms (e.g., Wix, hosting providers, plugins), for which the Client agrees to abide by their terms of use.

 

Fees and Payments

• Initial Website Creation Fee: A non-refundable deposit of 50% is required to secure your project. The remaining balance will be due according to the payment schedule in your agreement.

• Maintenance Fees: Monthly or annual maintenance fees will be billed as per the contract. Non-payment may result in suspension of services.

• Additional Costs: Any third-party costs (e.g., hosting, domain registrations, plugins) are the responsibility of the Client unless otherwise agreed.

• Payment Methods: Accepted payment methods include [list methods, e.g., credit card, PayPal, etc.].

 

Client Responsibilities

• Provide all required content (e.g., text, images, branding assets) in a timely manner.

• Approve deliverables at each milestone to prevent delays in the project timeline.

• Review and test the website thoroughly before the final approval.

 

NYX WebWorks is not responsible for delays caused by the Client’s failure to meet these responsibilities.

 

Revisions and Changes

• Included Revisions: The Client is entitled to [X] rounds of revisions as outlined in the agreement.

• Additional Revisions: Any revisions beyond the included rounds will be billed at the hourly rate of $50 or as agreed.

 

Intellectual Property

• Ownership: Upon full payment, the Client owns the final website design and its content, excluding any third-party licensed materials or tools.

• Portfolio Use: NYX WebWorks reserves the right to showcase the project in our portfolio and marketing materials unless the Client requests otherwise in writing.

 

Warranties and Liability

• NYX WebWorks provides all services “as is” and does not guarantee specific results, such as increased website traffic or sales.

• We are not liable for any damages caused by:

• Third-party services or tools integrated into the website.

• Unauthorized modifications made by the Client or third parties.

• Limited Support: Support for bugs or issues discovered post-launch is included for a period of 30 days. Ongoing support requires a maintenance agreement.

 

Termination

• Client-Initiated Termination: If the Client cancels the project before completion, refunds (if any) will be prorated based on work completed.

• Company-Initiated Termination: We reserve the right to terminate services if the Client fails to meet payment obligations or violates these Terms.

 

Confidentiality

Both parties agree to maintain confidentiality regarding proprietary or sensitive information shared during the project.

 

Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing legal action. Legal proceedings, if necessary, will be governed by the laws of California.

 

Updates to Terms

We reserve the right to update these Terms periodically. Updated Terms will be shared with Clients and posted on our website.
